Model Rule on Conflicts Arising
as a Result of Transfer Between Law Firms
The Model Rule below was adopted by the Federation's delegates in February 1994 as a result of the 1990 decision of the Supreme Court of Canada in Martin v. Gray. Since then, all Law Societies, to the exception of the Barreau du Québec, the Chambre des Notaires du Québec and the Law Society of Newfoundland and Labrador have adopted the Model Rule: some as is and some with minor modifications. The Barreau and the Chambre have advised that they will not adopt the model rule as they are of the view that the present rules within their jurisdiction are adequate to deal with conflicts arising as a result of transfers between law firms.
